Mediation is a confidential, facilitated negotiation between parties, procedurally controlled by a neutral third party with the authority to impose an outcome. The role of mediator is that of a facilitator and reconciliator. As well as an educator, resource expander and interpreter.
Mediators serve to create a positive tone, establish behavioral guidelines, explain procedures and educate parties on the process. A mediator will impartially control the proceedings and the flow of communication between parties. The goal is to understand all parties points of view concerning the issues, underlying circumstances, facts and positions and to assist in the improvement of the attitudes and understanding towards one another.
Through the process of mediation the validity of proposed solutions are tested and advanced. The development of options and suggestions is encouraged and communication is improved, so that issues may be clarified and feelings vented in the proper manner.
Mediation normally consists of a mediators opening statement, then parties each offer their statements and identify the issues. Dialogue is exchanged and options are generated. Finally, agreements are reached.
